1. Acceptance of Terms
By accessing or using the Communality website and services ("Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our Services.
2. Description of Services
Communality provides estate technology services including:
- Communality Safe: Access control and visitor management
- Communality Speed: Speed enforcement and compliance
Services are provided on a subscription basis to residential estates and complexes in South Africa.
3. Account and Subscription
- Estate-level subscriptions require authorisation from the estate's managing body (HOA, body corporate, or estate management company).
- You are responsible for maintaining the security of your account credentials.
- Subscriptions are month-to-month unless an annual agreement is in place.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period.
4. Acceptable Use
You agree not to:
- Use the Services for any unlawful purpose
- Attempt to access systems or data you are not authorised to access
- Interfere with or disrupt the Services
- Reverse engineer, decompile, or disassemble any part of the Services
- Use access control or speed enforcement data for purposes beyond estate management
5. Data Ownership and Privacy
- Estate data belongs to the estate. Communality processes data on behalf of the estate.
- Personal data is handled in accordance with our Privacy Policy and POPIA.
- Upon cancellation, you receive a full data export. We delete estate data within 30 days.
6. Hardware
- Hardware purchased from Communality is owned by the estate.
- Installation is performed by authorised partners (e.g., Regal Security).
- Hardware warranties are provided as specified at the time of purchase.
- Communality is not liable for damage caused by improper installation or modification by unauthorised parties.
7. Service Availability
We aim to maintain high service availability but do not guarantee uninterrupted access. The Services depend on third-party infrastructure including cloud hosting, LTE networks, and internet connectivity. We are not liable for outages caused by third-party service disruptions.
8. Limitation of Liability
To the maximum extent permitted by South African law:
- Communality is not liable for indirect, incidental, or consequential damages arising from use of the Services.
- Our total liability for any claim shall not exceed the fees paid by the estate in the 12 months preceding the claim.
- Communality is not liable for security incidents at your estate. Our Services provide tools for access control and monitoring, not physical security guarantees.
9. Speed Enforcement Disclaimer
Communality Speed provides tools for estate-level speed enforcement. It is not a substitute for law enforcement. Speed data and violation notices are provided as evidence for estate governance processes. Estates are responsible for establishing and communicating their own speed policies and enforcement procedures.
10. Intellectual Property
All intellectual property in the Services (software, designs, trademarks, content) remains the property of Communality. Your subscription grants you a non-exclusive, non-transferable licence to use the Services for their intended purpose.
11. Changes to Terms
We may update these Terms from time to time. Material changes will be communicated via email to registered users at least 30 days before taking effect. Continued use of the Services after changes take effect constitutes acceptance.
12. Governing Law
These Terms are governed by the laws of the Republic of South Africa. Any disputes arising from these Terms shall be subject to the jurisdiction of the South African courts.
